These Terms of Sale apply to the 100 East and Sas E Gems Fine Jewelry Web site located at www.100eastfinejewelry.com, as well as all interactions and transactions between you and 100 East and Sas E Gems. Please read these terms carefully. These terms may be changed by 100 East and Sas E Gems at any time, in its sole discretion, and are effective immediately upon posting on this website.  BY USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS OF SALE.

Purchasing Eligibility 

To buy our products, you must be 18 years old, a resident of the continental US, Hawaii or Alaska, and a bona fide end use customer (as determined by us in our sole discretion).

 

Delivery Area 

We ship only to addresses in the continental US, Hawaii or Alaska and to APO and FPO addresses. APO/FPO orders are limited to $25,000 and under. Additional restrictions may apply.

 

Pricing and Sales Taxes 

All prices shown on the website are in US Dollars. The stated prices do not include delivery costs, insurance or sales tax. We do not negotiate prices on our products. All our prices are final.

 

Comparison Purchasing

Due to increased transaction costs, we do not allow you to buy several items with the intent of keeping some and returning the remainder.

Gemstone Enhancement and Synthetic Gemstones

We disclose gemstone enhancements and treatments and do not use synthetic gemstones.

 

Order Placement, Payment Methods, Order Shipping Time, Order Tracking and Cancelling or Changing an Order

Payment Methods – We accept PayPal Payments, which may include paying through your PayPal account, using your credit or debit card via PayPal Guest Checkout, or financing via PayPal Credit. Contact PayPal for benefits of paying through PayPal. We are happy to accommodate a Bank Deposit, also known as wire transfer or credit transfer from your bank account to ours.

Placing an Order – On-line and phone orders are accepted.

  • On-line Order - for the person requiring no further assistance
    • From our store Checkout Page, first agree to the terms and conditions. Then:
      • Select the 'Continue with PayPal" button.
      • The PayPal Checkout Login portal will appear. PayPal offers the following payment options:
        • Login and pay from your PayPal account (PayPal Credit may be available)
        • Pay with PayPal Guest Checkout using credit or debit cards.
      • Complete the PayPal transaction using your payment method of choice.
      • Once PayPal notifies us the financial transaction is complete, we will email an Order Acknowledgement and shipping information.
  • Phone Order - For the person with questions, who requires more personalized service or requires resizing or engraving. Call 1-812-202-2143, click on the phone number on the page header or use the telephone icon on the Product Detail pages.
    • Payment - we will email a PayPal Invoice and an Order Acknowledgement.
    • Once the PayPal transaction is complete, we will email shipping information.
  • Email info@100eastfinejewelry.com or use the envelope icon on the Product Detail pages for questions, general inquiries or to request a phone appointment. For security reasons, orders will not be accepted via email, text or social media direct messaging.
  • NOTE: The Order Acknowledgement takes precedence over any conflicting information displayed on the website. Notify us immediately of any discrepancies.

Order Shipping Time - Orders generally ship 3-5 days following payment approval. We will notify you of any expected shipping delays.

Order Tracking - We will notify you of order status via email

Cancelling or Changing an Order - We have the right to cancel any order at our discretion. We will attempt to accommodate your order changes and cancellation requests if received prior to shipping.

 

Ring Sizes and Jewelry Resizing

Our Standard ring sizes are 6.5 and 7. Complimentary resizing is available for certain of our rings and bracelets. Resizing adds time to product delivery and renders the jewelry ineligible for return. If you are uncertain of your ring size, we have ring sizing instructions and devices we can send to assist you in measuring your ring finger.

 

Ring Engraving

Where technically feasible, engraving is available only for rings. An additional $25 per ring will be charged. Engraving adds time to product delivery and renders the ring ineligible for return. 

 

Resizing and Engraving Procedure

You must notify us of your intent to re-size or engrave when purchasing the item. Once you receive the item and confirm in writing that you desire resizing or engraving, the item will not be eligible for return. You must obtain a Return Authorization Number from us and follow the instructions for returns set out in these Terms. We will reimburse you for actual shipping and insurance costs you incurred in returning the item for resizing or engraving.

 

Special Orders

We do not make custom jewelry, but may modify an existing design. These special orders may increase the price and product delivery time, and sales are final when we receive approval to proceed to manufacture. A deposit is required prior to obtaining a quote. Quotes are valid for two weeks. If the quote is not approved, the deposit is refunded, less direct expenses including our labor. If the quote is accepted, a second deposit is required prior to initiating design work. If the design is not approved, the deposit is refunded, less direct expenses, including our labor. If the design is approved, the full amount of the quoted price must be paid prior to manufacture commencing. No further changes or cancellations will be accepted. Any information that you provide to us about our products is non-confidential and become our sole property for us to use. You warrant that any information you submit to us is accurate, non-misleading, non-infringing and that you have the right to provide such information to us for our use.

 

Packaging and Personalized Cards 

Our 100 East and Sas E Gems branded items are packaged in display boxes with an outer gift box. Gordon's Curated Selection items ship in soft fabric pouches. Complementary personalized cards will be included, if requested.

 

Shipping and Insurance

For deliveries to a single address totaling $500 or more (item price only), shipping and shipping insurance are complimentary. Orders less than $500 are shipped and delivery insured for a flat rate of $25. We require a delivery signature, regardless of order size. The actual cost of shipping and insurance will be deducted from the refund on any orders returned undeliverable or refused by recipient, other than due to damage or suspected tampering. We encourage you to immediately insure your jewelry purchase. 

Repairs

We recommend you consider us for your jewelry repairs and adjustments.

 

Applicable Law and Venue

These Terms of Sale will be governed by and construed in accordance with the laws of the State of Indiana. Any action at law or in equity arising out of or relating to these Terms of Sale shall be filed only in the state and federal courts located in Evansville, Indiana.

 

Attorney's Fees

If any disputes arise and we prevail, you are responsible for attorney fees incurred by us. 

 

Returns and Our 30 Day Satisfaction Guarantee Policy

To ensure you are completely satisfied with your jewelry purchase, we are pleased to offer a 30 day satisfaction guarantee for items purchased from 100 East and Sas E Gems Fine Jewelry.

If you want to make an exchange, 100 East and Sas E Gems Fine Jewelry recommends returning the original item for a refund or merchandise credit and placing a new order for the item you would like instead. However, should you prefer to make an exchange, please see the Exchanges section. NOTE: For all returns and exchanges, day 1 is the day you receive the item.

Details of the 30 day return policy:

  • Original Purchaser:
    • First 15 Days - Each item purchased is accepted for refund, including any pre-paid engraving charge, if returned unworn, tags never removed and as-new within 15 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature/support items.
    • Days 16 to 30 - Each item purchased is accepted for a nonrefundable merchandise credit if returned unworn, tags never removed and as-new within 16-30 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature/support items. Any unused, pre-paid engraving fee is applied to the merchandise credit. This merchandise credit must be used to purchase an item(s) of equal or greater value than the amount of the credit. You will pay the difference. No refunds are possible.
  • Gift Recipients:
    • First 30 Days - If the item was a gift and the recipient wishes to return it without involving the original purchaser, a nonrefundable merchandise credit can be provided if the item is returned unworn, tags never removed and as-new within 30 calendar days from the day we shipped the item to the original purchaser or gift recipient, when accompanied by original packaging and documentation/literature/support items. Any unused, pre-paid engraving fee is applied to the merchandise credit. This merchandise credit must be used to purchase an item(s) of equal or greater value than the amount of the credit. You will pay the difference. No refunds are possible.
    • We will not inform the original purchaser the item was returned.
  • Exceptions: 
    • Special orders, resized jewelry, engraved rings or any other special services are not eligible for return.
    • Items that have been worn, used, damaged or altered in any way cannot be accepted for return.
    • Items whose tags have been removed (even if re-attached) at any time cannot be accepted for return.
    • Unauthorized returns or any other failure to comply with our policy or follow our return procedures will not be reimbursed.
    • It is expected that in addition to the jewelry item, all related packaging and documentation/literature/support items included in the original shipment be returned. Failure to return all these materials may result in a reduction of the refund or merchandise credit to recover the cost of these items.
    • During the month of December, a special extension of the time period for returns is possible. Ask us about the extension.
  • Additional requirements and clarifications:
    • Return shipping and insurance costs incurred by the person returning the jewelry and wire transfer fees incurred by us will be borne by the person returning the item. The wire transfer fee will be deducted from the refund or nonrefundable merchandise credit.
      • COD shipments will be refused and returned to sender. Any costs incurred by you for shipping COD are at your expense.
    • A refund of a bank deposit (aka wire transfer) can only occur via bank deposit by crediting the same bank account used for the original purchase transaction.
    • Until you are certain you will keep the item(s), save the original shipping boxes, including all original packaging and documentation to use for the return.
    • General Return Instructions will be included in the shipping box with the purchased jewelry item(s).
      • Prior to any return, you must notify us, and we will issue a Return Authorization Number (RAN) and our Returns Procedures.
        • The (RAN) must be printed on the shipping case in order to be accepted and processed by us.
        • Packages sent to us without first obtaining the RAN and/or which do not show the RAN on the shipping case will be refused and returned to you. Any additional costs incurred by you for failure to obtain the RAN or display it on the shipping box are at your expense.
    • We strongly urge you to insure the item(s) for its full purchase price, request a signature upon delivery and keep proof of return shipment. We are not responsible for lost, stolen or damaged returned shipments and accept no liability in the event proof of return shipment cannot be produced. Only merchandise received by us will be eligible for a refund.
    • All returns will be subject to strict Quality Control inspection by us to ensure the returned products are in their original purchase condition (unworn, unaltered, tags intact and never removed, in saleable condition with vendor packaging and documentation/literature returned). If the products do not meet QC standards, we will deny the return, and the products will be returned to the Customer or Gift Recipient, as applicable. If the returned product passes our QC inspection, we will proceed with the refund or nonrefundable merchandise credit.
      • Please allow 3-4 weeks for the return to be processed, inspected and returned to inventory prior to initiating the credit to your account.

Once your return has been processed, please allow an additional 7-10 days for the refund to appear in your bank account or for the merchandise credit to be issued.

 

Exchanges

Rather than make an exchange, 100 East and Sas E Gems Fine Jewelry recommends returning the original item for a refund or merchandise credit and placing a new order for the item you would like instead. However, should you prefer to make an exchange:

  • Original Purchaser:
    • First 15 Days - Each item purchased is accepted for an exchange for any item in stock if returned unworn, tags never removed and as-new within 15 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature/support items. If the replacement item is priced lower than the original item, 100 East and Sas E Gems Fine Jewelry will refund the difference in price less any wire transfer fees we incur. If the price of the replacement item is higher, you pay the difference
    • Days 16 to 30 - Each item purchased is accepted for exchange for an item in stock of equal or greater value if returned unworn, tags never removed and as-new within 16-30 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature/support items. You will pay the difference. No refunds are possible.
  • Gift Recipients:
    • First 30 Days - If the item was a gift and the recipient wishes to exchange it without involving the original purchaser, an exchange for an item in stock of equal or greater value can be provided if the item is returned unworn, tags never removed and as-new within 30 calendar days from the day we shipped the item to the original purchaser or gift recipient, when accompanied by original packaging and documentation/literature/support items. You will pay the difference. No refunds are possible.
    • We will not inform the original purchaser that the item was exchanged.
  • All other terms as outlined above in the Exceptions and Additional Requirements sections of the Returns and Our 30 Day 100% Satisfaction Guarantee Policy apply.

 

Military Returns from APO and FPO Addresses

We understand that packages shipped to overseas APO/FPO addresses will take longer to arrive. Therefore, we take that into account should you decide to return your order, as follows:

  • Original Purchaser:
    • First 30 Days - Each item purchased is accepted for refund if returned unworn, tags never removed and as-new within 30 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature.
    • Days 31-45 - Each item purchased is accepted for a nonrefundable merchandise credit if returned unworn, tags never removed and as-new within 31-45 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature/support items. This merchandise credit must be used to purchase an item(s) of equal or greater value than the amount of the credit. You will pay the difference. No refunds are possible.
  • Gift Recipients:
    • First 45 Days - If the item was a gift and the recipient wishes to return it without involving the original purchaser, a nonrefundable merchandise credit can be provided if the item is returned unworn, tags never removed and as-new within 45 calendar days from the day we shipped the item to the original purchaser or gift recipient, when accompanied by original packaging and documentation/literature/support items. This merchandise credit must be used to purchase an item(s) of equal or greater value than the amount of the credit. You will pay the difference. No refunds are possible.
    • We will not inform the original purchaser that the item was exchanged.

Military Exchanges from APO and FPO Addresses

Rather than make an exchange, 100 East and Sas E Gems Fine Jewelry recommends returning the original item for a refund or merchandise credit and placing a new order for the item you would like instead. However, should you prefer to make an exchange from an overseas APO and FPO address:

  • Original Purchaser:
    • First 30 Days - Each item purchased is accepted for an exchange for any item in stock if returned unworn, tags never removed and as-new within 30 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature/support items. If the replacement item is priced lower than the original item, 100 East and Sas E Gems Fine Jewelry will refund the difference in price less any wire transfer fees we incur. If the price of the replacement item is higher, you pay the difference
    • Days 31 to 45 - Each item purchased is accepted for exchange for an item(s) of equal or greater value if returned unworn, tags never removed and as-new within 31-45 calendar days from the day we shipped the item to you, when accompanied by original packaging and documentation/literature/support items. You will pay the difference. No refunds are possible.
  • Gift Recipients:
    • First 45 Day - If the item was a gift and the recipient wishes to exchange it without involving the original purchaser, an exchange for an item(s) of equal or greater value can be provided if the item is returned unworn, tags never removed and as-new within 45 calendar days from the day we shipped the item(s) to the original purchaser or gift recipient, when accompanied by original packaging and documentation/literature/support items. You will pay the difference. No refunds are possible.
    • We will not inform the original purchaser that the item was exchanged.
    • All other terms as outlined above in the Exceptions and Additional Requirements and Clarifications sections of the Returns and Our 30 Day 100% Satisfaction Guarantee Policy apply.

 

Disclaimer of Warranty

THE PRODUCTS AND SERVICES PROVIDED BY 100 EAST AND SAS E GEMS FINE JEWELRY ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 100 EAST AND SAS E GEMS FINE JEWELRY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR TITLE. 

 

Limitation of Liability

IN NO EVENT SHALL 100 EAST AND SAS E GEMS FINE JEWELRY, ITS DIRECTORS, MEMBERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH OUR PRODUCTS AND SERVICES, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY USER ON ANY INFORMATION OBTAINED FROM 100 EAST AND SAS E GEMS FINE JEWELRY, OR THAT RESULT FROM MISTAKES, OMISSIONS, ERRORS, DEFECTS, DELAYS OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO 100 EAST AND SAS E GEMS FINE JEWELRY’S RECORDS, PRODUCTS OR SERVICES.
