These terms of sale apply to the 100 East Fine Jewelry Web site located at www.100eastfinejewelry.com, as well as all interactions and transactions between you and us. Please read these terms carefully. These terms may be changed by us at any time, in our sole discretion, effective immediately upon posting on this website. BY USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS OF SALE
To buy our products, you must be 18 years old, a resident of the continental US, Hawaii or Alaska, and a bona fide end use customer, as determined by us in our sole discretion.
PRICING AND SALES TAXES
Prices listed on the website are in US Dollars and are not negotiable. We do not conduct sale events, clearance sales or offer coupons. We comply with all state and local sales tax laws.
NATURAL GEMSTONES AND DISCLOSED TREATMENTS
All gemstones used in 100 East and Sas E Gems branded jewelry are natural and individually selected for desirability, color, clarity, cut and cost. They were formed by Mother Nature, not in a lab (known as synthetic, lab created, man-made or simulants).
Natural gemstones are commonly treated to enhance their color and/or clarity. Many of our colored gemstones are treated. However, we use only gemstones whose treatments are considered permanent and we disclose all treatments on the Product Detail page of each piece. This allows you to make an informed purchase decision.
You can order on-line at our website or by phone. For security reasons, we do not accept orders via email, text, fax or social media Direct Message. If you have questions, always feel free to email email@example.com or call or text 812-202-2143. We welcome dealing with you directly and are thrilled to take your phone order. We’re here for you!
Our on-line order process is straight forward. Items you’ve selected from your cart are processed through our secure server and directed to PayPal for payment or credit application. Once PayPal approves the transaction, we will notify you by email and initiate the fulfillment process.
Please call us if you desire to pay by wire transfer or set up a layaway arrangement. Once placed, we will provide payment instructions and an Order Acknowledgement. Please note, our Order Acknowledgement takes precedence over any conflicting information displayed on the website. Notify us immediately of any discrepancies.
We strive to make your purchase secure. Our payment process is designed so you can buy with confidence knowing your sensitive personal financial information is not shared by us. We utilize:
- PayPal Payments, either through our website check-out or by invoicing you directly.
- Financing is available through PayPal Credit, subject to consumer credit approval. Visit PayPal.com to learn the benefits of paying or financing through PayPal.
- Call us if you wish to pay with a Bank to Bank Wire Transfer (aka bank deposit or credit transfer) from your bank account to ours. We do not allow you to send your bank account or routing information in writing and we won’t send you our account information in writing either.
- We are happy to offer a 2 to 4 month interest-free Layaway Plan. No credit check is required. With a 25% minimum deposit, the remaining balance must be evenly spread over 2, 3 or 4 monthly installments, whichever best serves your needs. We will set the item aside and send it once final payment has cleared. Should you decide to cancel the layaway at any time, we will return your money less any expenses we incur.
Layaway and Bank to Bank Wire Transfer (aka bank deposit or credit transfer) are not website check-out options. They are only possible by calling us at 812-202-2143. We are extremely sensitive to the potential for fraud or deception and we may request additional information prior to shipping, for your protection and ours. Failure to adequately respond may result in shipping delays, at a minimum, or, at our sole discretion, order cancellation.
Orders shipped to an address other than your billing address must be paid for in one of the following ways:
- Through PayPal. PayPal and 100 East Fine Jewelry may request additional information or actions prior to shipping. Failure to adequately comply may result in shipping delays, at a minimum, or, at our sole discretion, order cancellation.
- As a direct Bank to Bank Wire Transfer (aka bank deposit or credit transfer) from your bank account to ours. Once payment is received, we will prepare the item for shipment.
ORDER PROCESSING TIME
Each order is thoroughly inspected and securely packaged in two shipping cases for additional product protection in the event of shipping damage. Orders generally leave our facility 5 to 6 business days following payment approval. We will notify you of any expected shipping delays. SPECIAL NOTE: Due to the uncertainty associated with the Coronavirus, shipments may be delayed. We will provide you with estimated shipping dates once the order is received. Jewelry pieces are sanitized prior to shipping.
Once we turn your order over to the shipping carrier, the standard in-transit time is 2 to 3 business days. For shipments to a single address totaling $500 or more (item price only), shipping and shipping insurance are complimentary. Orders less than $500 are shipped and delivery insured for a flat rate of $25. We require a delivery signature, regardless of order size. For any orders returned undeliverable or refused by recipient, other than due to damage or suspected tampering, our cost of shipping and insurance will be deducted from the refund.
At the point of delivery, while the delivery person is present and before signing for the package, please inspect the package carefully for any signs of damage or tampering. Should you see either condition, refuse delivery. If possible, take pictures of the package, send them to us and retain the photos for future reference.
We will notify you of order status and provide shipment tracking information via email.
We have the right to cancel any order at our discretion. We will attempt to accommodate your order change and cancellation requests when received prior to shipping.
WHITE GOLD JEWELRY AND RHODIUM PLATING
Some of our white gold jewelry pieces are rhodium plated. Read the Product Detail sheet of each piece made with white gold where we disclose whether or not it’s rhodium plated. All our white gold jewelry is made from a gold alloy which contains nickel. If you are interested in an item that is not rhodium plated but want it plated, we will electroplate it for you, at no additional charge. This increases delivery time. Rhodium plating cannot be removed.
Complimentary ring resizing is available with each purchase. If a bracelet can be resized, we will provide a quote for the additional costs of resizing.
All jewelry pieces on our website are pre-made. Our rings are manufactured to either size 6.5 or 7. Bracelet sizes vary in size and style. We provide important ring and bracelet dimensions on each Product Detail page, along with resizing capability. Contact us during the purchase process to address ring and bracelet size questions. To help you determine your ring and bracelet size, articles are available in the Education Section of our website and plastic ring sizers may be sent upon request, no purchase necessary. SPECIAL NOTE: Resizing increases order processing time and renders the item ineligible for return.
If you want a monogram, name or special message engraved on the inside of a ring’s band, we will work with you to determine if your message is possible. We offer either laser or hand engraving options. Cost estimates are provided upon request. SPECIAL NOTE: Engraving increases order processing time and renders the ring ineligible for return.
PACKAGING AND PERSONALIZED CARDS
Our 100 East and Sas E Gems branded items are packaged in elegant display boxes with an outer gift box. Gordon's Curated Selection items ship in soft fabric pouches. Complementary personalized gift cards will be included, if requested.
PRODUCT RETURNS AND OUR 30 DAY SATISFACTION GUARANTEE POLICY
If you aren’t 100% satisfied with our product, return it. No questions asked! We will accept eligible items back for full credit if return shipped within 30 calendar days of the day we shipped the item. Certain limitations apply. If you want to exchange an eligible item, we strongly recommend returning it and placing a separate, new order. However, should you still prefer to make an exchange, please see the Exchanges section below.
30 day return policy for the original purchaser:
Days 1 to 15 – Eligible items will be accepted for refund if returned unworn, tags never removed and as-new within 15 calendar days from the day we shipped the item to you, when accompanied by original display packaging and documentation/literature/support items.
Days 16 to 30 – Eligible items will be accepted for a nonrefundable merchandise credit if returned unworn, tags never removed and as-new within 16 to 30 calendar days from the day we shipped the item to you, when accompanied by original display packaging and documentation/literature/support items. This merchandise credit must be used to purchase an item(s) of equal or greater value than the amount of the credit. You pay the difference. No refunds.
30 day return policy for gift recipients:
Days 1 to 30 – Eligible items received as a gift will be accepted for a nonrefundable merchandise credit to the gift recipient if returned unworn, tags never removed and as-new within 30 calendar days from the day we shipped the item to the original purchaser or gift recipient, when accompanied by original display packaging and documentation/literature/support items. This merchandise credit must be used to purchase an item(s) of equal or greater value than the amount of the credit. You pay the difference. No refunds. We will not inform the original purchaser the item was returned.
Additional terms of the 30 day satisfaction guarantee policy:
- From Thanksgiving through December, we may provide a slight extension to the 30 day return time period. Ask us.
- Unauthorized returns or failure to comply with our return policy or procedures may affect return eligibility.
- A return shipment from the customer or gift recipient is considered compliant with the policy if the return is documented as shipped by the applicable deadline and later received by us.
- Special orders, resized jewelry and engraved rings are not eligible for return.
- We recommend saving all original packaging and documentation until you’re certain you’ll keep the item. The original display packaging is required and use of the original shipping materials upon return is recommended.
- Unused, pre-paid engraving fees are applied to the credit.
- Return shipping and insurance costs incurred by you will not be reimbursed.
- Wire transfer fees incurred by us will be deducted from the refund or merchandise credit.
- Prior to returning an item, you must notify us by phone at 812-202-2143 and obtain a Return Authorization Number (RAN).
- We will issue the (RAN) along with return instructions.
- The (RAN) must be printed on the shipping case in order to be accepted and processed by us.
- Packages sent without the RAN on the shipping case will be refused and returned at your expense.
- Do not ship returns COD. They will be refused and returned at your expense.
- All refunds will be issued solely using your original payment method.
- Insure the return for the full purchase price, request a delivery signature and retain proof of shipment. We are not responsible for lost, stolen or damaged returned shipments. Only merchandise we receive is eligible for a refund.
- Each return will undergo a strict Quality Control inspection to verify the items are in their original purchase condition (unworn, unaltered, tags intact and never removed, in as-new condition with original display packaging and documentation/literature/support items returned). After passing our QC inspection, we will process the refund or nonrefundable merchandise credit. Please allow 2 to 3 weeks for processing. Returns failing the QC inspection will be denied and returned to the person initiating the return.
We recommend returning your jewelry item for a refund or merchandise credit and placing a new order for the replacement. However, should you still insist on making an exchange, here are the details:
Exchanges by the Original Purchaser:
Days 1 to 15 – Eligible items will be accepted for exchange for any item(s) in stock if returned unworn, tags never removed and as-new within 15 calendar days from the day we shipped the item to you, when accompanied by original display packaging and documentation/literature/support items. If the replacement item(s) is priced lower than the original item, 100 East Fine Jewelry will refund the difference in price. If the price of the replacement item(s) is higher, you pay the difference.
Days 16 to 30 – Eligible items will be accepted for exchange for any item(s) in stock of equal or greater value if returned unworn, tags never removed and as-new within 16 to 30 calendar days from the day we shipped the item to you, when accompanied by original display packaging and documentation/literature/support items. You pay the difference. No refunds.
Days 1 to 30 - Eligible items received as a gift will be accepted from the recipient for exchange for any item(s) in stock of equal or greater value if returned unworn, tags never removed and as-new within 30 calendar days from the day we shipped the item to the original purchaser or gift recipient, when accompanied by original display packaging and documentation/literature/support items. You pay the difference. No refunds. We will not inform the original purchaser the item was exchanged.

RETURNS FROM APO AND FPO ADDRESSES
We appreciate your service to our Country! We understand that packages shipped to overseas APO/FPO addresses can take longer than domestic shipments. We take that into account should you decide to return an eligible item, by adding 15 days to our PRODUCT RETURNS AND OUR 30 DAY SATISFACTION GUARANTEE POLICY. The 15- and 30-day return deadlines are each extended by 15 additional calendar days. All other terms as outlined in the “Additional terms of the 30 day satisfaction guarantee policy” and “Additional requirements” sections of the PRODUCT RETURNS AND OUR 30 DAY SATISFACTION GUARANTEE POLICY apply.
EXCHANGES FROM APO AND FPO ADDRESSES
We recommend returning your jewelry item for a refund or merchandise credit and placing a new order for the replacement. However, should you still insist on making an exchange from an overseas APO/FPO address, the policy is the same as our EXCHANGES Policy, except we add 15 calendar days to account for longer delivery times. The 15- and 30-day return deadlines are each extended by 15 additional calendar days. All other terms as outlined in the “Additional terms of the 30 day satisfaction guarantee policy” and “Additional requirements” sections of the PRODUCT RETURNS AND OUR 30 DAY SATISFACTION GUARANTEE POLICY apply.
We are not custom jewelers. There are many fine custom designers who would love your business. However, if you desire one of our designs, but prefer to make it your own, we may be able to customize that design to achieve your vision. If you’d prefer a different metal or stone type or color and maybe some ‘minor tweaks’, ask us, we might be able to help you. Be aware, there is a fine line between a ‘minor tweak’ to an existing design and a major modification of the design.
If we feel your vision is something within our scope, we will not modify an existing jewelry piece. We will create a special order from scratch. Undertaking this special order will involve a series of discrete steps entailing periodic quotes, commitments and deposits. Special orders can increase price, and will increase order processing time and render the item ineligible for return. Bringing your particular vision to life may be worth it, though!
Consider us for your jewelry repairs and adjustments. We know our pieces better than anyone!
WE WARRANT THAT, FOR A PERIOD OF THREE MONTHS FOLLOWING DELIVERY BY US, THE PRODUCTS PURCHASED FROM US WILL BE FREE FROM DEFECTS IN WORKMANSHIP RELATING TO THE METALWORK ON THE JEWELRY. EXCEPT FOR THE LIMITED WARRANTY LISTED ABOVE, PRODUCTS AND SERVICES PROVIDED BY 100 EAST FINE JEWELRY ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 100 EAST FINE JEWELRY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR TITLE.
OUR RESPONSIBILITY FOR DEFECTIVE WORKMANSHIP RELATING TO THE METALWORK ON THE JEWELRY IS LIMITED TO REPAIR, REPLACEMENT OR REFUND, IN OUR SOLE DISCRETION. This limited warranty extends only to the original purchaser of products and not to any subsequent owner. This limited warranty does not apply to lost, broken or damaged gemstones. This limited warranty does not cover damages due to transportation; storage; improper use; failure to follow product instructions; modifications; unauthorized repair; normal wear and tear; or external causes such as accidents, abuse, or other actions or events beyond our reasonable control. The Warranty Period is not extended if we repair or replace a warranted product. To obtain warranty service, you must call us at 812-202-2143 during the warranty period.
These Terms of Sale will be governed by and construed in accordance with the laws of the State of Indiana. Any action at law or in equity arising out of or relating to these Terms of Sale shall be filed only in the state and federal courts located in Evansville, Indiana.
If any disputes arise and we prevail, you are responsible for attorney’s fees incurred by us.
LIMITATION OF LIABILITY
ASIDE FROM THE REMEDIES DESCRIBED ABOVE, WHICH ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF THE LIMITED WARRANTY, IN NO EVENT SHALL 100 EAST FINE JEWELRY, ITS DIRECTORS, OWNERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH OUR PRODUCTS AND SERVICES, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY USER ON ANY INFORMATION OBTAINED FROM 100 EAST FINE JEWELRY, OR THAT RESULT FROM MISTAKES, OMISSIONS, ERRORS, DEFECTS, DELAYS OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO 100 EAST FINE JEWELRY’S RECORDS, PRODUCTS OR SERVICES.
